Cafepress has sent me another IP violation notice, this one even more specious than the last.
Apparently some company has trademarked the phrase “spoiled brat.” Go figure.
In accordance with our Intellectual Property Rights Policy, Allen, Dyer, Doppelt, Milbrath & Gilchrist, P.A, the law firm representing Vertical Production the trademark owners of “Spoiled Brat” provided us with a notice in which it alleged that an image used in your Shop infringes its intellectual property rights. Based on this notice, we removed your Shop from our servers.
I’m sorry, but how exactly can a graphic I created of a pair of common English words be trademarked by a company I’ve never heard of? This is absurd on its very face. This is frivolous litigation at its finest.
